Dying wife begs judge Yellowknife man jailed 34 months despite her pleasNathalie Heiberg-Harrison Northern News Services Published Friday, May 20, 2011
"The only family I have here is Karl," the terminally ill cancer patient said of her common-law husband, Karl Nayally. "I don't have that long." Nayally, 46, pleaded guilty to impaired driving, dangerous driving, failing to provide a breathalyzer sample, resisting arrest and breaking bail conditions. Judge Robert Gorin sentenced him to 34 months in jail and a 15-year driving ban. Gorin said he took into account Nayally's lengthy criminal record, which included 34 prior convictions - five for driving while impaired, four for driving while prohibited and 11 for disobeying court orders. The latest charges against Nayally stemmed from incidents in May 2010 and last month. In 2010 he was charged with impaired driving and refusing to provide a breathalyzer sample after being pulled over by police. After giving the RCMP a fake name, they searched his car and found six bottles of vodka as well as his real identification. He told police it was his twin brother's. Last month, he was involved in a police pursuit in Yellowknife after police received reports of an erratic driver speeding, swerving and disregarding stop signs just off of Old Airport Road. After stopping for police in the Co-op parking lot, he sped off again and didn't stop until just outside of the Sandstone Apartments on Finlayson Drive. He resisted arrest, suffered cracked ribs during his struggle with two RCMP officers and tried to kick in the safety barrier between the front and back seat of the police car.
