SOMBA K'E/YELLOWKNIFE - The Crown's case against former RCMP Sgt. Larry Edward O'Brien may be coming to a resolution. On April 19, O'Brien's preliminary inquiry and trial date scheduled for May 9 to 12 were cancelled by Judge Robert Gorin in territorial court. A new court date of May 10 was scheduled to speak to the matter.

Gorin also ordered a pre-sentence report to be available on May 9. O'Brien, who did not appear in court on April 19, was represented by defence lawyer Caroline Wawzonek.

O'Brien, 45, is accused of stealing $2,000 from an RCMP locker and breach of trust of a public officer in 2008, threatening five members of the Yellowknife RCMP and uttering forged documents in 2009. O'Brien, who has resigned from the RCMP after 21 years of service, previously entered not guilty pleas to all the charges.

Impersonation case back in court May 9

A Yellowknife man will be facing a territorial court case for allegedly fraudulently impersonating another person.

Crown prosecutor Danielle Vaillancourt decided to treat the charge against the 37-year-old accused as a summary offence on April 19 in territorial court. Summary offences involve lesser sentences upon conviction.

The Crown originally elected to treat the matter as an indictable offence on March 8, 2011, which would have involved a Supreme Court trial. The individual is accused of "fraudulently impersonating" another person on July 7, 2010, with the intent to "gain advantage for himself" relating to a GNWT tender.

The case is next scheduled for territorial court on May 9 at 9:30 a.m.

Aggravated sex assault case delayed

An HIV-positive Yellowknife man charged with three counts of aggravated sexual assault against three different women had his case adjourned for two weeks on April 19 to give his lawyer time to look at the file.

Bobby Jonathan Kaotalok, 25, was expected to choose whether to have his case decided by judge and jury or by judge alone in Supreme Court. However, defence lawyer Anthony Parr told Judge Robert Gorin he recently received "about 1,000 pages" of information from the Crown and needed time to prepare.

Gorin set a new date of May 3 where the accused will elect his preferred method of trial.

Kaotalok has been in custody since his Feb. 24 arrest. The offences are alleged to have happened between January 2008 and December 2010.
