Cpl. Kent McEachern said a bylaw officer alerted the RCMP when he spotted Moses Aupaluktuq's personal vehicle in the ditch near his home at about 3:30 a.m. on Nov. 7.

McEachern said the RCMP found a man passed out inside the vehicle when officers arrived on the scene.

"Mr. Aupaluktuq has been charged with being in care and control of a motor vehicle while under the influence of drugs or alcohol, as well as care and control while having a blood-alcohol level over .08," said McEachern.

He said the individual provided a breath sample for the breathalyzer and was very co-operative.

The accused MLA is scheduled to make his first court appearance in Baker Lake on Feb. 9.

McEachern said the RCMP has concluded its investigation, laid the charges, and now it will be up to the court to decide the outcome.

"His vehicle had been backed into the ditch out in front of his house.

"We found (a man) sleeping behind the wheel intoxicated, so we charged him accordingly.

"Whether he's convicted or not by the court is another thing and only time will tell."
