Man found guilty in summer stabbing behind Raven

YELLOWKNIFE - A 21 year-old man was found guilty on Wednesday of aggravated assault for a stabbing that happened behind the Raven Pub last summer.

Delroy Morgan was charged after a fight in the early morning hours of July 23, 2006, that left the victim with stab wounds on his forearms, his torso and the back of his head.

The victim later suffered a collapsed lung from the wounds while in the hospital.

Justice Louise Charbonneau said one of the challenges of the trial was that the majority of the witnesses were intoxicated during the incident.

"It's not surprising that there were many inconsistencies in the account of the witnesses," Charbonneau told the court April 4 upon delivering her verdict.

During the trial, an RCMP officer presented photos of the scene and diagrams of the area around Raven's Pub including the parking lot and the alley behind the pub where the stabbing took place.

A video of Morgan taken shortly after the incident where he describes to a police officer what he can remember from the evening, was also shown to the court.

"I just remember we got kicked out of the bar because the lights went out," Morgan said in the video. "I don't remember anything at all."

Charbonneau said that since Morgan couldn't remember any of the details, his statement that he "would have remembered if he stabbed someone," didn't help his situation.

In her ruling, Charbonneau reviewed testimony from other witnesses that she did find credible, including one witness who saw a man similar to Morgan with a knife get into a car.

The car the witness saw matched the description of the car Morgan said he left in.

The victim testified he had initially been fighting Jeffrey Morris, who had also been charged with aggravated assault.

That charge was dropped during the preliminary inquiry due to a lack of evidence.

The victim testified he had been fighting Morris, then Morris fell to the ground. The victim then turned around to face Morgan.

Although the victim could not say why he turned around, he said he remembered fighting with Morgan and could feel that he had been stabbed.

Other witness testimony said that they saw the victim notice he was bleeding only after the fight when he started feeling weak. Charbonneau said that she accepted the victim's testimony, as he admitted to things that painted him in a negative light.

However, with the confusing testimony and what Charbonneau described as a "chaotic" evening, Charbonneau said she could only find Morgan guilty of stabbing the victim in the back of his head.

Charbonneau set Morgan's sentencing for April 12.
