Man jailed for breaching conditional sentence

Yellowknife (July 21/06) - A Cambridge Bay man was sentenced to finish the rest of his conditional sentence in a Yellowknife jail for failing to uphold the sentence.

Judge Bernadette Schmaltz called his actions "a blatant breach of conditions."

The 25-year-old man disobeyed orders several times to remain in his residence, except between 1 p.m. and 3 p.m.

The breaches occurred in March and June.

The man, who now lives in Yellowknife, was originally sentenced for operating a motor vehicle while intoxicated and dangerous driving in Cambridge Bay.

The man will be in jail until Aug. 30.

Last chance to get lawyer

A 48-year-old man charged with two counts of assault with a weapon last December has one more chance to get a lawyer.

Wednesday was the third time his territorial court trial has been adjourned since April.

A key witness in the case against him did not show up and so the Crown asked to move the case to Sept. 29 at 9:30 a.m.

The man told the judge he tried to find counsel, but was unable to contact the particular lawyer he wanted.

"What do I need to say to you to make you understand that this matter will go ahead whether or not you've contacted a lawyer?" said Judge Bernadette Schmaltz.

This is not the first time the man has been warned. According to court transcripts, Judge Brian Bruser made a similar comments in a May 31 hearing.

The man is also charged with three counts of breaching conditions of his release and one count of failing to appear in court.

Man jailed 21 days for failing to appear

A man who failed to appear in court twice spent the past three weeks in jail.

The 26-year-old was in court Tuesday, after having missed appearances on June 29, 2004 and May 31, 2005 to deal with an assault charge from April 24, 2004.

Judge Bernadette Schmaltz said she did not appreciate the fact that the man had shown up for some court dates, but not others.

"I don't see showing up sometime as an improvement," she said.

The man was remanded into custody June 27 and held in jail to ensure he would show up in court. He was released from custody after the court hearing.
