Beaulieu, Yellowknives Dene await ruling

Yellowknife (May 30/01) - Darrel Beaulieu and the Yellowknives Dene First Nation were in territorial Supreme Court Monday, seeking to quash $63,001 in fines levied last year under the Fisheries Act.

The charges were laid when the Deton'Cho Corp. moved gravel and debris from a housing development in Ndilo to an area facing Back Bay, which the Department of Fisheries and Oceans considers prime fish habitat.

Defence lawyer Richard Gariepy said that there were errors in the original case, and that testimony from some witness raised more questions than answers.

The Crown argued that sufficient evidence was called during the trial and asked the court to increase the fines.

The Yellowknives Dene First Nation was fined $60,000, and Beaulieu had $3,000 levied against him personally. The Deton'Cho Corporation was fined $1.

Mr. Justice John Vertes reserved his decision.
