Her husband and co-accused Craig will be tried by judge and jury in the same trial.
On Feb 19, 2009, the MacNearney's were arrested after police found 20 marijuana plants and a "large amount" of cultivated pot in their home.
Other media sources reported that the MacNearney's children were taken away by social services during their arrest.
Kim, who suffers from chronic back pain, did not have a medical marijuana license at the time of her arrest. She was able to apply for one soon after her arrest, and received it in 2010. Kim now advocates for the legalization of marijuana.
On April 20, 2012, commonly known as "4/20" among marijuana users, Kim conducted a one-woman protest supporting legalization of marijuana in Yellowknife. The next year, at least two dozen people showed up in support of the cause in the city.
If convicted of marijuana production, the MacNearneys could face at least six months in jail, according to the Controlled Drugs and Substances Act.
