Frame Lake Trail suspect in court Terrence McEachern Northern News Services Published Friday, June 10, 2011
Anthony William Griep is accused of sexually assaulting a 19-year-old female after allegedly grabbing her from behind and dragging her into the bushes on the Frame Lake Trail on June 5, 2008, according to a June 1, 2011, RCMP press release. The press release also states Griep was arrested on May 30 after tests performed in April revealed his DNA, obtained following a conviction for an unrelated crime, positively matched DNA evidence from the 2008 attack. Despite the seriousness of the charges and the police's assertion of a positive DNA match, Griep was released on bail the same day of his arrest by Justice of the Peace Barbara Barnet on several standard conditions, including that he forfeit $200, keep the peace and be of good behaviour, have no contact with the complainant and check in with the Yellowknife RCMP between 9 a.m. and 5 p.m. Monday to Friday. On Wednesday, defence lawyer Baljindar Rattan told Judge Bernadette Schmaltz she received additional disclosure from the Crown in the form of seven CDs full of information and needed time to review the disclosure with her client. Griep sat quietly at the defence table Wednesday wearing jeans and a blue and white plaid shirt while his lawyer addressed the court. Schmaltz granted the defence's request for an adjournment and set Griep's next court appearance for July 11 at 9:30 a.m. where the defence is scheduled to elect whether the case will be tried by judge alone or by judge and jury. Griep has yet to enter a plea on the charges. Griep was previously in court on Tuesday where Crown prosecutor Marc Lecorre said the Crown was proceeding on both charges as indictable offences, which hold greater punishment than summary offences if Griep is convicted. Griep faces up to 10 years in prison for each offence. At Lecorre's request, Judge Garth Malakoe issued a ban prohibiting the publication of any information that could identify the complainant. Rattan represented Griep on Tuesday and Wednesday; however, it wasn't known if she was going to be retained by the accused as permanent counsel for the defence. After both court appearances, Griep fled from reporters waiting outside the courthouse and ran into a red SUV parked nearby.
